Terms of Service

These terms and conditions (the “Terms”) shall apply to all services provided by All In Foundation, a Swedish foundation (registration no. 559067-4288 (“All In”, “we” and “us”). The Terms and our Privacy Police guides You through the use of the Application (as defined below).

By creating an account in the Application and using our Service (defined below), You are considered to have agreed to the Terms. Thereby, these Terms constitute an agreement between the user (the “User” or “You”) and All In. The purpose of these Terms is to clarify under which terms and conditions You as a user may use the Application, the Platform and the services provided therein. If You do not wish to be bound by this agreement, do not use the Application. By accepting the Terms, You also confirm that have read and understood the Privacy Policy available in the Application.

All In reserves the right to change the Terms at any time. Any material changes to the Terms will be notified to You by notification within the Application. You are responsible to keep Yourself informed of any changes to the Terms.

1. SERVICE

1.1. General

All In provides a digital platform (the “Platform”) where registered users can donate (“Donation”) to highly effective charitable organizations (“Partner Organization”). Our aim is to offer a simple, transparent and effective way of raising funds for high-impact charity projects and to create a social charity network of like-minded individuals (the “Purpose”). The Platform is available for registered users on our mobile application (the “Application”). In the Application users can donate money to charity projects (the “Projects”) included and listed there.

The partnership between All In and the Partner Organizations is for charity purposes only. All In has no control over any Partner Organization or any other third parties, therefore All In is not liable and assumes no responsibility for any actions taken or the failure to act by any such third party.

1.2.Registering an account

In order to be given access to the Services made available through the Application, You are required to register a user account (“Account”). You create an Account by completing the registration form provided to You by All In via the Application.

1.3.Information about Projects and Partner Organizations

In the Service, You can browse between selected Projects. Each Project page contains a description of the project as well as other relevant information which has been elaborated in close collaboration with our Partner Organizations to ensure that the information displayed is correct. Despite thorough review of the information by All In and the Partner Organizations, we cannot guarantee that that the information made available is correct. 2. DONATIONS AND CONFIRMATION

2.1. Donating

Donating to a Project of Partner Organizations is simple. You browse among the listed Projects in the Application, select the Project that you want to donate to, indicate the amount of money that you want to donate and proceed with the payment options offered in the Application.

Any Donation made by using the Services are made as gifts and are therefore final and non-refundable. [With exception for refunds made in accordance with 7 (Refunds), no Donations will be refunded]

2.2.Confirmation of Donation

A confirmation of your Donation will be sent to you via the application. Your history of donations will also appear under your profile with the Application.

2.3.Fees

All In is a non-profit foundation and our own operating costs are covered by separate contributions from private individuals. Using our service is free – we do not charge any administrative or service fee from your Donation nor do we charge any service fee from Partner Organizations.

However, depending on the terms for the selected means of payment (i.e. bank, card provider and other transaction costs) there may be fees associated with a Donation which are charged to All In and will be deducted from the Donation. Over time, All In intends to also cover transaction fees from donations.

2.4.Payments

At the moment, we offer Swish as the payment solution for both the Android and iOS Application which can only be used in connection with a Swedish account. There is no transaction fee for payments made via Swish. In addition, Apple Users can make a Donation via Apple Pay. These Donations are processed through our third-party payment processor, Stripe Inc., for which the following card transaction costs apply (for European cards Visa/Mastercard):

  • For transactions under 50 SEK the fee is: 2.7% of the Donation and 0,50 SEK
  • For transaction over 50 SEK the fee is: 1.2% of the Donation and 1,80 SEK

3. PARTNER ORGANIZATIONS AND PROJECTS

All In conducts extensive research to find highly effective, transparent and trustworthy organizations whose Projects have been tested and generate high impact. All In also aims to ensure that Partner Organizations use 100 percent of All In donations for the cause itself and do not cover fundraising fees of Partner Organization. Organizations who comply with this 100% model are clearly marked within the Application.

All Donations, however, are made at the risk of the User and the User making a Donation is responsible for controlling and considering the applicable Partner Organization’s and Project’s legitimacy, purposes and goals.

All In’s Services include allowing Users to direct their Donation to a specific Project within a Partner Organization. A direction is, however, not regarded as a condition for the Donation but rather a non-binding request and recommendation. All In will and cannot, however, guarantee that the Donation made by a User is used in the intended way and in compliance with the Users expectations.

4. USER’S RESPONSIBILITIES

You are responsible of submitting accurate and complete information about Yourself and it is Your responsibility to keep this information updated and complete going forward.

You may use the Application for Your own individual use. You are personally responsible for Your Account details (including passwords and access codes) and the use of the Application as well as all of Your communication and activity on it. Users are not allowed to use the Application for any purpose other than the Purpose (as defined in Section 1.1.).

5. DATA PROTECTION

To access the Platform and use the Services made available via the Application, You are required to provide personal information. Personal information that You may be requested to provide includes, but is not limited to, full name, telephone number, and email address.

All In is controlling the personal data provided and obtained in conjunction with the use of our Application and Services. All processing of personal data takes place in accordance with applicable law. For more information about how we process personal data, see our “Privacy Policy” available in the Application.

6. REFUNDS

Donations are considered as gifts, they are final and non-refundable. However, if a Project is cancelled and there is no other Project available to receive Your Donation or there is any other reason resulting in Your Donation having to be returned, we will issue a full refund.

In the event Your Donation is to be returned in accordance with the above, All In will inform You by sending a notification to you within the Application.

Reimbursements will be made using the same payment method as the one used by You when You made the Donation. Any transaction costs resulting from the reimbursement will be covered by the User.

7. INTELLECTUAL PROPERTY

All Intellectual Property (as defined below) is the sole property of All In. Your use of the Application and its content grants You no right, title or interest to any software, source-code, copyright, design, trademarks, or any other content and intellectual property (“Intellectual Property”) included in the Application.

8. TERMINATION OF ACCOUNT

All In works hard to ensure that the Application is safe and secure. No User may use the Application for any purpose other than the Purpose and may not in any way violate or attempt to violate the security of the Application.

All In reserves the right to suspend a user or terminate an Account if a User:

i) breaches or otherwise violates the Terms; or

ii) uses the Application in a way that does not comply with the Purpose;

iii) invades any person’s or legal entity’s privacy;

iv) misidentifies or impersonate any person or entity;

v) pretends to represent any company or organization that You are not affiliated with or authorized to represent; or

vi) otherwise uses the Application in any way that is harmful or offensive for All In or any third person.

9. LIMITATION OF LIABILITY

Users shall indemnify, defend and hold harmless All In from and against any claim brought against All In alleging that Your content violates any law or infringes the rights of any third party.

In no event shall All In be liable for any indirect damages.

All In shall not be liable for any delay or failure to perform due to circumstances that are beyond our control.

Any claims or complaints relating to our Application or Services shall be notified to us as soon as possible by sending an email to info@allin.foundation

12. CHANGES & ADDITIONS

The Terms may be amended from time to time. The version of the Terms applicable on Your order is the one that was in force at the time that You placed the order. The latest version of the Terms will be available in the Application.

13. TERMS & TERMINATION OF ACCOUNT

These Terms are valid and in force until either i) You terminate Your Account or ii) we terminate Your Account and access to the Application in accordance with Section 8 (Termination of Account).

You are entitled to terminate Your account at any time. To terminate Your Account, contact All In directly. Once You have terminated Your Account, we will delete or anonymize any personal information about You, with exception for any personal information that we are required to keep under applicable laws and regulations.

14. GOVERNING LAW AND DISPUTES

These terms and any issues concerning them shall be governed by construed in accordance with the laws of Sweden.

Any dispute, controversy or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof, shall be finally settled by arbitration administered by the Arbitration in accordance with the Rules of Arbitration by the Institute of the Stockholm Chamber of Commerce. The seat of arbitration shall be Stockholm, Sweden.
